The weather at Playa Tortuga Chiriqui has been described by one property owner is being like Maui in the Hawaiian Islands. We get a fresh side-onshore ocean breeze that kicks in everyday at 25-30 kph. We also do not experience the rains that the Caribbean side of Panama gets or the rains that the Highlands of Chiriqui receive. Because of the side-onshore breeze it will be clear and sunny at Playa Tortuga Chiriqui while rainy and cloudy elsewhere in the area. Many people that live in Chiriqui try to compare the weather in the our area hotter than that in David. This is not the case because of the proximity of the our area in relationship to the Pacific Ocean and the corresponding sea-breeze.
The location of Playa Tortuga Chiriqui in relationship to the 10 kilometers border zone ( Article 121, revised by Law #2) location of the property is Certified by the Institution of Geography in Panama City.
Playa Tortuga Chiriqui is located across the bay from Punta Burica and is outside of the 10 kilometer border zone by approx. 13.8 kilometers or approx. 3.8 kilometers from the 10K border point (Our Location Implemented) which is located at the first bridge coming into the City of Puerto Armuelles. Playa Tortuga Chiriqui is NOT located on the Peninsula of Punta Burica which lies well within the 10 kilometers of the border. Playa Tortuga Chiriqui is not within the City Limits of Puerto Armuelles which also lies within the 10 kilometers of the border. By being outside of the 10 kilometers of the border the legal status of ownership of property is never a question.
Article 121 of the tax code and the revision made to Article 121 of the Tax Code by Law #2. Article 38. Article 121 of the Tax Code shall read as follows:
Article 121. No foreign natural or legal person and no national legal person of foreign capital, whether partial or total, may acquire land from the State or private persons, which are situated less than ten kilometers (10KM) from the borders. However, the rights acquired upon the entry into effect of the Constitution shall be respected, but the corresponding assets may be expropriated at any time, with the payment of an adequate indemnification. By being located outside of the 10 kilometers your investment will not run into any legal issues of that of being inside of the 10 kilometer border zone.
